The recent passage of Israel’s new death penalty law has sparked outrage and reflection on the complexities surrounding international human rights standards and Israel’s ongoing policies toward Palestinians. As the global community watches, the response—or lack thereof—from entities like the European Union raises critical questions about the commitment to human rights amidst rising tensions and violence in the region. This situation not only affects the Palestinian population but also poses a challenge to the moral underpinnings of international law and diplomacy.
Preparations for the implementation of Israel’s controversial death penalty law are in full swing, as National Security Minister Itamar Ben-Gvir has announced the construction of a new prison wing designated for executions. He has also confirmed the procurement of distinctive “red” uniforms for Palestinian prisoners, a stark symbol of the impending measures.
The international response has been notably muted. Prominent bodies such as the European Union, which touts a commitment to high human rights standards, have largely chosen to look away despite the clear implications of the law. The EU’s Association Agreement with Israel includes explicit human rights clauses that remain disregarded.
The reaction from European officials has been dismissive of the potential human rights violations inherent in the new legislation. Following a meeting of the National Security Committee of the Knesset, the EU’s spokesperson for foreign affairs, Anouar El Anouni, expressed “deep concern” about the bill, affirming the bloc’s long-standing opposition to the death penalty. However, he simultaneously lauded Israel’s purported adherence to democratic principles, conveniently ignoring the country’s long history of occupation and violations of international law.
In a joint statement issued by several European nations, including the Netherlands, France, Germany, Italy, and the United Kingdom, leaders reiterated their concern about the bill without specifying any concrete actions to counter it. Following the bill’s passage on March 31, the EU issued another watered-down statement lamenting a “grave regression” in Israel’s commitments, a position that appears at odds with numerous findings from global investigative bodies that highlight ongoing human rights abuses.
Crucially, the voices of the Palestinian people remain conspicuously absent from official discourse. The new law targets them specifically, yet there has been no acknowledgment of the immense suffering endured by Palestinian families affected by the ongoing conflict. Personal narratives, such as that of a former political prisoner whose family has experienced the repercussions of such legislation, reveal the human cost of these policies. The current circumstances echo the stories of many who have resisted oppression, reminding us of the ongoing struggle for dignity and justice in the region.
The EU’s approach in this context is not merely a strategic oversight but rather a reaffirmation of its selective commitment to human rights. This hypocrisy is glaringly evident when juxtaposed with the EU’s staunch condemnation of the death penalty in countries such as Iran and Belarus, as well as calls for accountability in Saudi Arabia and the United States. While the EU has taken a firm stance on human rights elsewhere, it has inexplicably faltered in advocating for Palestinians.
As Israel continues its actions that contravene international law, including expanding its occupation, increasing settlement activity, and restricting access to holy sites, European citizens are increasingly voicing their discontent. More than one million Europeans have signed onto the “Justice for Palestine” initiative, advocating for a full suspension of the EU-Israel Association Agreement—the fastest-growing petition of its kind to date.
The time has come for the EU to critically assess its legal obligations and align them with the voices of its citizens. As discussions continue at the Foreign Affairs Council, member states face a pivotal decision: to act decisively against the injustices wrought upon the Palestinian people or remain complicit in a system that undermines the very values they claim to uphold. The challenge is clear: uphold international law, respond to public demand for justice, and end the cycle of impunity.
