The memorandum allows for collaboration between Biden administration officials and Trump’s team, facilitating briefings and the exchange of critical information regarding government operations and ongoing projects. Incoming chief of staff Susie Wiles emphasized the importance of this engagement, stating that it enables the intended Cabinet nominees to initiate essential preparations, including establishing connections across all departments and agencies.
Despite these advancements, the memorandum does not include agreements typically signed by incoming administrations. Crucially, it does not establish a partnership with the Department of Justice for conducting background checks for nominees through the FBI, a standard process designed to maintain governmental integrity. Furthermore, the agreement lacks the authorization from the General Services Administration (GSA), which supports the transition by allowing the collection of donations to fund transition activities. Under normal circumstances, major-party candidates are required to sign the GSA agreement by October 1 of an election year, ensuring transparency by requiring public disclosure of donations exceeding ,000. As a result, without the GSA agreement, Trump may miss out on the .2 million allocated for presidential transitions.
Wiles characterized the decision to bypass these agreements as a means of promoting organizational autonomy, asserting that the transition team already has in place adequate security and information protections. She referred to this approach as a decision to forgo taxpayer funding for transition-related costs, framing it as a demonstration of self-sufficiency.
While the Biden administration has raised concerns regarding the deviation from established practices, White House spokesperson Saloni Sharma underscored the importance of a smooth transition for the safety and security of the nation.
