Three former members of Brazil’s Federal Highway Police have received significant prison sentences for their involvement in the tragic death of Genivaldo de Jesus Santos, a 38-year-old Black man who died while in police custody. This case has drawn widespread attention and highlights ongoing concerns about police conduct in Brazil.
On Saturday, Justice Rafael Soares, presiding over the 7th Federal Court in Sergipe, sentenced Paulo Rodolpho Nascimento to 28 years in prison for committing aggravated homicide. His colleagues, William Noia and Kleber Freitas, were each sentenced to 23 years for their roles in torturing Santos, which ultimately led to his death.
The incidents surrounding Santos’s death began on May 2022, when he was pulled over for not wearing a helmet while riding his motorcycle near Umbauba. Videos taken by bystanders depicted Santos as nonviolent and compliant during the police encounter. Contrarily, the officers claimed he was “actively resisting.” During the initial moments of the incident, it was reported that Santos, who endured schizophrenia, communicated to the officers that he was taking medication. Nevertheless, he was forcibly placed in the trunk of their vehicle.
A harrowing video captured by witnesses showed officers sealing the trunk as clouds of white smoke poured from the car, accompanied by Santos’s anguished screams. Eyewitnesses expressed profound concern, fearing for his life. Prosecutors indicated that Rodolpho launched tear gas inside the trunk, while Freitas deployed pepper spray, contributing to Santos’s suffering. An autopsy later revealed that he died from asphyxiation, underscoring the severity of the officers’ actions.
Throughout the trial, expert testimonies detailed the circumstances of Santos’s death, revealing he endured over 11 minutes in an enclosed, toxic environment. Following the verdict, the three officers were dismissed from duty.
Santos’s sister, Laura de Jesus Santos, expressed a mixture of relief and sadness regarding the outcome. While she acknowledged it as a satisfactory resolution, she emphasized the complex emotions surrounding justice in such tragic circumstances.
In a broader context, a United Nations report earlier this year outlined alarming statistics regarding police violence in Brazil, noting over 6,000 fatalities annually in law enforcement interactions. The report spotlighted the disproportionate impact on the Black community, with individuals of African descent constituting nearly 83 percent of fatalities involving police.
