Lithuania has formally launched legal proceedings against Belarus at the International Court of Justice (ICJ), alleging that its neighbor has been instrumental in creating a crisis involving refugees and migrants by facilitating smuggling operations across their border. The Lithuanian Justice Minister, Rimantas Mockus, emphasized the importance of accountability in his statement, insisting that the Belarusian government must face legal repercussions for its alleged role in fostering illegal migration and the associated human rights violations. The case filed at The Hague centers around accusations of Belarus violating the United Nations Protocol against the Smuggling of Migrants by Land, Sea and Air. Lithuania’s Ministry of Foreign Affairs noted that initial efforts to address these issues through bilateral discussions had been unsuccessful. The evidence presented by Lithuania indicates direct involvement of the Belarusian state in orchestrating the movement of refugees and migrants, particularly highlighting a notable increase in flights from the Middle East, conducted by state-owned Belarusian airlines.
Lithuanian officials reported that many passengers arriving in Belarus were subsequently escorted to the Lithuanian border by Belarusian security forces, ultimately being compelled to cross illegally. Additionally, Lithuania has criticized Belarus for its lack of cooperation with border services aimed at preventing these irregular crossings. As part of the legal proceedings, Lithuania seeks damages, specifically related to the financial burdens incurred in bolstering its border security infrastructure.
Tensions between Lithuania and Belarus have escalated since 2021 when there was a surge of individuals from the Middle East and Africa attempting to cross into Lithuania, Poland, and Latvia.
