ICC prosecutor to temporarily step aside pending investigation into alleged misconduct.

The chief prosecutor of the International Criminal Court (ICC), Karim Khan, has announced a leave of absence as he awaits the conclusion of a United Nations-led investigation into allegations of sexual misconduct against him, which he firmly denies. This decision reflects Khan’s commitment to upholding the integrity of the court during this period of scrutiny.

In a statement on Friday, Khan’s office shared that he has chosen to temporarily step aside while the UN Office of Internal Oversight Services (OIOS) conducts its investigation. The inquiry has been ongoing since December, following complaints directed to the ICC’s oversight body. Khan has articulated his intention to cooperate fully with the investigation.

Allegations against Khan first came to light in October, and amid escalating pressure from human rights organizations and ICC officials, his decision to take leave has been seen as a necessary step to maintain the institution’s credibility. Danya Chaikel, a representative of the human rights organization FIDH, emphasized the importance of this action for the alleged victim and whistleblowers, suggesting it serves as a moment of acknowledgment and respect.

As the ICC navigates this internal investigation, the court’s two deputy prosecutors are set to assume Khan’s responsibilities, ensuring that ongoing cases continue to progress. The timeline for the OIOS investigation’s completion remains uncertain, contributing to the atmosphere of anticipation surrounding the court’s future actions.

The ICC is currently engaged in several high-profile investigations, including inquiries into Russia’s military actions in Ukraine and Israel’s military operations in Gaza. Khan has notably pursued arrest warrants for prominent figures, including Russian President Vladimir Putin, for alleged unlawful deportation of children, as well as Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant for purported war crimes in Gaza.

The actions of the ICC have drawn considerable international attention, not least from the United States, which has openly criticized the court’s moves against Israeli officials and has imposed sanctions on Khan as a result. This tension highlights the delicate balance the ICC must maintain within a complex geopolitical landscape, underlining the institution’s role in addressing alleged human rights violations on a global scale.

As the investigation proceeds, the ICC’s ability to effectively navigate these challenges will be critical in reaffirming its position as a crucial player in international justice. The ongoing scrutiny underscores the importance of accountability and transparency at all levels of governance.
