A recent report from the United Nations has raised significant concerns regarding Israel’s claims that Palestinian armed groups are misusing hospitals in Gaza for military purposes. The UN human rights office, in its findings released on Tuesday, described these allegations as “vague” and outlined the devastating impact of continuous Israeli attacks on healthcare facilities, which are protected under international law.
According to the comprehensive 23-page report, covering the period from October 7, 2023, to June 30, 2024, there have been at least 136 attacks on 27 hospitals and 12 other medical facilities. These attacks have resulted in considerable casualties among healthcare workers and civilians, causing extensive damage to the medical infrastructure in Gaza, a territory already burdened by a fragile healthcare system.
The report emphasized the importance of international humanitarian law, which explicitly protects medical personnel and hospitals from attacks, provided they are not engaged in acts that harm the enemy outside of their humanitarian roles. The UN noted that insufficient publicly available information has been presented to support the allegations made by Israel, suggesting that they remain broad and imprecise. Moreover, the systematic destruction of these medical facilities could be conceived as a form of collective punishment, which may amount to a war crime under international law.
UN High Commissioner for Human Rights Volker Turk highlighted the tragic irony that hospitals, which should serve as sanctuaries for care and healing, have turned into sites of danger for many Palestinians. He stressed the paramount importance of protecting healthcare facilities during conflicts, urging all parties to adhere strictly to these protections.
In the latest developments, Israel has escalated its attacks on the Kamal Adwan Hospital in northern Gaza, leading to the detention of its director. The World Health Organization has reported that the remaining patients and staff at the facility were transferred to the nearby Indonesian Hospital, which has been rendered largely non-functional.
Former Israeli diplomat Alon Pinkas remarked that even if evidence were provided to substantiate claims of Hamas utilizing these medical facilities for military purposes, such justification would not warrant attacks on hospitals. He noted the disconnect between bold claims and the lack of supporting evidence.
The UN report called for credible and independent investigations into the attacks on healthcare facilities, expressing concern over the constraints of Israel’s legal processes in dealing with its armed forces’ actions. It is crucial, emphasized Turk, that all violations of international humanitarian law be thoroughly investigated and that all medical personnel who have been arbitrarily detained be released immediately. Furthermore, Turk asserted that Israel, as the occupying power, must prioritize and ensure access to adequate healthcare for the Palestinian population.
