International Court of Justice rejects Sudan’s genocide case against UAE for alleged support of RSF rebels.

The International Court of Justice (ICJ), the principal judicial body of the United Nations, recently opted not to proceed with a case involving Sudan’s allegations against the United Arab Emirates (UAE). The case centered around accusations that the UAE breached the genocide convention by allegedly providing arms and funding to the Rapid Support Forces (RSF), a paramilitary group implicated in Sudan’s ongoing civil unrest.

On Monday, the ICJ determined that it lacked the jurisdiction to consider Sudan’s claims, effectively dismissing the case. While both nations are signatories to the 1948 genocide convention, the UAE maintains a provision in the treaty that limits jurisdiction granted to the Hague-based court.

In March, Sudan called upon the ICJ to impose provisional measures, requesting the UAE to take action to prevent violence and other crimes against the Masalit people in Darfur. Sudan’s appeal emerged from a backdrop of intense violence in the region, which has been marked by deep-seated ethnic tensions. The ruling, however, indicated that the court could not engage with the merits of Sudan’s claims due to jurisdictional constraints.

The UAE characterized Sudan’s legal move as a publicity stunt aimed at diverting attention from the ongoing conflict within Sudan itself. At a recent hearing, UAE representatives argued convincingly that the ICJ did not have the authority to hear the case, a viewpoint the court upheld in its ruling.

Following the dismissal, the UAE celebrated the decision as a legal victory. Reem Ketait, Deputy Assistant Minister for Political Affairs at the UAE’s Ministry of Foreign Affairs, stated that the ruling reaffirms the UAE’s non-involvement in Sudan’s conflict and stresses that the nation is unjustly accused of contributing to the situation.

The court’s decision follows troubling developments in Sudan, which spiraled into a civil war in mid-April 2023 due to escalating tensions between military and paramilitary forces. Both the RSF and Sudan’s military have faced accusations of committing severe abuses throughout this conflict. While the UAE of late has been subjected to scrutiny for its alleged connections to the RSF, it has firmly denied any involvement, emphasizing its stance as a proactive partner committed to stability and peace in the region.

With the ICJ’s ruling and the UAE’s reassurances, the focus now shifts back to the internal complexities of Sudan, where the international community remains concerned about the violent clashes impacting civilian populations.
