Trump is not the reason for the potential downfall of the International Criminal Court.

In the shifting landscape of global justice, the International Criminal Court (ICC) faces significant challenges, particularly from the United States. As Washington escalates its aggressive stance against the court, supporters of international law are compelled to rally in defense of this crucial institution, which has the mandate to address egregious crimes and uphold accountability on the world stage.

The International Criminal Court (ICC) is currently under intense scrutiny and pressure from the United States, which has consistently demonstrated a desire to undermine the institution’s authority. This persistent effort stems from a belief within the U.S. government that it can operate without accountability for its actions on the international stage. The implications of this stance are profound, as credible allegations of U.S. involvement in international crimes continue to surface.

Historically, the U.S. has sought to diminish the role of the ICC since its inception. Particularly during the presidency of George W. Bush, there was a pronounced focus among Republican officials on challenging the court’s effectiveness, despite the fact that no warrants have ever been issued for American citizens. Figures such as former national security adviser John Bolton and Secretary of State Mike Pompeo exemplify this fixation. Ironically, the vehement critique of the ICC by U.S. officials has inadvertently elevated the court’s stature among many global observers, who see such disdain as a testament to the ICC’s potential impact on curbing U.S. imperialism.

The current climate, however, appears more threatening than in previous years. Recent U.S. sanctions against ICC staff members and bold declarations to dismantle the court “brick by brick” signal an alarming escalation that could jeopardize the institution’s existence. Without strong support from its member states, the ICC may face a precarious future. Indeed, the responsibility to defend the ICC rests not with a single leadership figure but with its member states, whose collective action is vital.

While some encouraging expressions of support have emerged primarily from European and South American nations, they fall short of what is needed for the ICC to thrive. To reinforce the court’s mandate, member states should take concrete steps to reaffirm their cooperation with ongoing investigations and to bolster efforts to enforce arrest warrants. They should also work to recruit additional member states, particularly in light of recent withdrawals by Venezuela and Chad, which were influenced by U.S. pressure.

An example of a nation that could strengthen the court is Lebanon, which has been considering joining the ICC. Such a move would grant the court jurisdiction over actions involving Israeli officials and groups like Hezbollah, effectively providing Lebanon a platform to counteract external pressures and uphold the rule of law. This could also demonstrate to Lebanese citizens the broader international commitment to justice and accountability.

Financial backing is another critical area where ICC supporters can make a significant impact. Although some critics argue that the ICC’s budget is excessive, the court operates at a fraction of the daily expenses incurred by U.S. military actions. Increased financial support would show that member states prioritize accountability for war crimes, crimes against humanity, and genocide, particularly in regions like Ukraine, Palestine, and Darfur.

Moreover, protecting ICC staff targeted by sanctions is essential for the court’s future. Judges have faced financial restrictions that limit their ability to perform their duties simply for fulfilling their obligations to the law. The European Union and Canada have legal frameworks that could mitigate the effects of these sanctions, yet their lack of initiative to utilize these measures has left many ICC officials vulnerable.

Efforts to stymie the U.S. backlash against the ICC require decisive and coordinated action from its supporters. The current assaults on the court are part of a broader strategy aimed at discrediting it and isolating its proponents. As such, the commitment to uphold the ICC is not merely about preserving an institution; it is a critical stance against the idea that any individual or nation is above the rule of law. Reforming the court rather than dismantling it is essential to ensuring that perpetrators of serious international crimes are held accountable.

The ICC remains a fundamental entity in the quest for global justice. Protecting its integrity is paramount in asserting that no one, regardless of power or influence, is shielded from accountability.
