Electric vehicle manufacturer Tesla is facing a significant lawsuit related to a devastating fatal crash in the United States, where all five occupants of a Model S reportedly could not escape the vehicle due to a design flaw. The incident took place in Verona, Wisconsin, on November 1, 2024, when the car veered off the road and collided with a tree, leading to the tragic deaths of Jeffrey and Michelle Bauer, aged 54 and 55, respectively, just a day later.

The lawsuit was filed on Friday by four of their children, alleging that the vehicle’s lithium-ion battery pack caused the electronic door systems to malfunction, effectively trapping their parents inside the burning car. The Bauer children contend that Tesla was aware of the risks associated with fire incidents in their vehicles, yet they failed to follow established safety practices that could have prevented such a situation.

Tesla, headquartered in Austin, Texas, and run by CEO Elon Musk, did not provide a comment immediately following the suit’s filing. This case comes on the heels of other lawsuits against Tesla, including one from the families of two college students who died in a crash involving a Cybertruck last November, allegedly due to the vehicle’s door handle design which also failed to function during an emergency.

Adding to the scrutiny, the National Highway Traffic Safety Administration is currently investigating potential defects in Tesla’s door mechanisms after multiple reports indicated that door handles may fail under certain conditions. The Bauer children highlighted that rear-seat passengers, especially, were vulnerable because they would have to locate a hidden metal tab under the carpeting to exit, a method that is not intuitive.

A nearby homeowner reported hearing distress calls from within the vehicle during the incident, emphasizing the terrifying moments the occupants faced. The lawsuit accuses Tesla of creating a foreseeable risk that occupants could become trapped in a burning vehicle after a crash, a scenario that directly contradicts the safety expectations associated with modern automobiles.

In addition to Tesla, the lawsuit names the estate of the driver, who is also accused of negligent driving, highlighting the complexities of liability in such tragic events. Interestingly, despite the lawsuit, Tesla’s stock saw a 2.5 percent increase at the close of trading on the day following the news, reflecting the market’s general confidence in the company amidst these challenges.
